Users Terms of Agreement

This document describes the User Terms of Agreement for the Linden Bay Romance, LLC, (LBR) on-line web site, www.lindenbayromance.com, ("Site"). If any part of these terms are objectionable, the user should not register with, access or use this Site.

This site is owned and operated by Linden Bay Romance, LLC, (LBR). LBR has the right at any time to change or discontinue any aspect or feature of the web site (site), without limitation.

1. Jurisdiction

The Agreement is legal and binding in all countries. Should there be any legal dispute, the laws of the State of Florida, USA shall apply.

2. Warranties by User

(a) User understands that access to individual accounts are password protected and warrants that their account only be accessed by the user.

(b) User understands that the Site contains copyrighted material, trademarks, and other proprietary information. User acknowledges that all content on the Site is the property of their respective owners and should not be copied without permission of the rights holder. Re-use or re-distribution of any and all materials is prohibited under law. User understands downloading copyrighted material does not result in a transfer of rights. Making illicit copies is in violation of copyright law.

(c) User warrants that LBR, its subsidiaries, affiliates, and third party content providers have the right to assert and enforce provisions directly or on its own behalf.

(d) User agrees to defend, indemnify and hold harmless LBR, its subsidiaries, affiliates, and third party content providers from and against any and all claims, actions, demands, damages, costs, liabilities, losses and expenses arising out of your use of the Site.

(e) User acknowledges that LBR will not provide refunds. We will replace damaged content with either an undamaged file of the work, or a work or equal value. Requests for replacement of damaged files will be requested within Seventy-two (72) hours of purchase and be made via the "contact us" portal which can be accessed from the bottom of any page on the Site.

(f) User warrants that LBR has the right to put a temporary hold on your account if fraud is suspected. Access to your personal library would not be allowed during the hold period.

(g) User warrents that LBR has the right to terminate.

3. Disclaimer of Warranty; Limitation of Liability.

Any use of the site is at your sole risk. The site is provided on an "as is" basis without warranties of any kind, either express or implied. LBR shall not be liable for misuse of other parties or the unlawful conduct of other parties.

LBR shall not be liable or obligated with respect to the subject matter of this agreement or under any contract, negligence, strict liability or other legal or equitable theory for any amounts in excess in the aggregate of the fees paid to it with respect to the applicable material.

LBR shall not be liable with respect to any damages associated with marketing, promoting, displaying, selling, transmitting, use and/or distribution of Works.

4. Restrictions

LBR reserves the right to decline a user registration at LBR's sole discretion, and may terminate a users access at any time and for any reason.

5. Changed Terms.

LBR has the right at any time to change or modify these Terms of Use, or any part thereof, or to impose new conditions. Such changes, modifications, additions or deletions shall be effective immediately upon posting on the site and deemed accepted by you upon subsequent use of the site.

By completing the registration process, the User hereby acknowledges and agrees to these terms.
